National Taipei University of Business has launched the nation’s first Master’s Program in Trade Practice Law and Negotiation, positioning itself with both a practice-oriented and international-oriented focus. The program is dedicated to cultivating hands-on professionals for industry, private organizations, and the public sector who possess both integrated expertise in international trade and economic law and strong English negotiation skills. It is suitable for applicants with good English proficiency and strong logical thinking who intend to pursue careers in corporate foreign negotiations, contract management, dispute resolution, trade remedy work, or international trade negotiations in the public sector.
This program is a regular master’s degree program, and graduates are awarded the Master of Business Administration (MBA) degree. All required courses are taught entirely in English. Core elective courses are also conducted in English in principle, unless the nature of the course makes this inappropriate. The program places strong emphasis on internships and encourages students to replace the traditional master’s thesis with a practice-oriented thesis. The curriculum is designed with a high degree of flexibility to accommodate different career plans. Required courses are mainly offered in the first academic year. In the second year, in addition to taking advanced professional courses, students may undertake full-time internships or pursue dual-degree programs at well-known foreign law schools. Although this is not an in-service program, course scheduling is flexible and suitable for working students.
Program Orientation
Guided by the principles of being practice-oriented and international-oriented, the program’s fundamental mission is to cultivate professionals for industry who combine integrated expertise in international trade and economic law with English negotiation competence. Under these principles, “integrated expertise in trade and economic law” refers to a comprehensive and applied knowledge system that takes practical legal knowledge as its backbone and is complemented by broad financial and economic knowledge, with a focus on real-world trade practice. “English negotiation competence” goes beyond basic language proficiency and encompasses a full set of cross-border communication, persuasion, and negotiation concepts and skills that integrate both theory and practice.
Key Teaching and Research Focuses and Features
In line with its developmental orientation, the program’s curriculum is designed to be strongly practice-oriented, with participation from industry professionals in teaching and the support of off-campus internships. At the same time, it emphasizes an international perspective in course content, student composition, and teaching activities, with the goal of effectively cultivating professionals with real-world trade expertise. The key features are as follows:
1. Solid Knowledge of Trade Practice — Centered on “Applied Law and Legal Application”
In view of the unique importance of legal knowledge in trade practice, the program takes “applied law and legal application” as its core, integrating knowledge related to international trade practice to form a comprehensive and integrated system of professional expertise. From the perspective of applied law, this integrated knowledge base includes the public law, private law, and commercial customs relevant to international trade activities. From the perspective of legal application, students are also required to learn financial accounting related to trade, the international business environment, and corporate strategies, enabling them to grasp both the details and the overall picture and to apply their knowledge effectively in practice.
2. Comprehensive English Negotiation Competence
The program places strong emphasis on cultivating cross-border economic and trade negotiation competence, which complements the law-centered professional knowledge in trade practice. To this end, a series of distinctive courses are offered, including Business English Writing, English Oral Argumentation, Principles of Persuasion and Communication, Drafting and Management of English Commercial Contracts, and Negotiation Theory and Practice. Through the integration of theory and practice, these courses systematically enhance students’ negotiation skills in trade and economic affairs. In addition, the large number of courses taught in English further strengthens students’ ability to handle trade and economic issues in English.
3. Generalist Trade Negotiators with Specialized Expertise
In addition to general training objectives, the program also sets distinctive specialization goals based on the university’s characteristics and student profiles, aiming for both depth and differentiation. First, it seeks to cultivate professionals in various fields of trade and business (including investment, taxation, finance, and accounting) with the ability to prevent and resolve international disputes. Second, it aims to train professionals in both the public and private sectors who possess solid expertise in trade remedy practices.
國立臺北商業大學開辦全國首創「貿易實務法律暨談判碩士學位學程」,以「實務導向」及「國際導向」為基本定位,將致力於為產業界、民間機構、公部門,培育兼具「整合性經貿法律專業知識」與「英語交涉能力」的實戰人才。適合英語程度及邏輯思維較佳,有意投入企業界擔任與對外交涉、合約處理、爭議管理等有關工作,或投入貿易救濟工作,或投入公部門對外經貿談判者報考。
本學程為正規碩士班學制,畢業授予商學碩士學位。必修課採全英語授課,核心選修除依其性質不宜全英語授課者外,亦以英語授課為原則。本學程強調實習,並鼓勵以「實務導向論文」代替傳統碩士論文。本學程之課程安排具有高度彈性,方便不同生涯規畫。必修課排在第一學年,第二學年除繼續修習 進階專業課程外,亦有機會全職實習或出國修讀知名法學院雙聯學位。另,本學程雖非在職專班,但授課時段具有彈性,便於在職生修讀。
發展定位
循著「實務導向」及「國際導向」為產業界培育兼具整合性經貿法律專業知識與英語交涉能力的實戰人才,乃本學程之基本定位。在「實務導向」及「國際導向」的原則下,所謂「整合性經貿法律專業知識」,是著眼於經貿實務,以實用法律知識為經,廣博的財經知識為緯的一套綜合性應用性知識體系。而所謂「英語交涉能力」並非以英語文能力為已足,而是一套融合了理論與實務的跨國界溝通、說服、談判概念與技巧。
教學研究重點及特色
根據發展定位,本學程之課程設計一方面力求實務導向,其講授亦將力求引進實務界人士參與,再輔以校外實習;另一方面力求國際導向,包括課程內容、學生、教學活動等,均具有國際意識,期能有效培養出經貿實戰人才。教學研究重點及特色分述如下:
1.紮實的經貿實務知識--以應用法律暨法律應用為主軸
鑒於法律知識在經貿實務操作上的獨特重要性,本學程以「應用法律、法律應用」為中心,串連經貿實務相關知識,提供一套見樹又見林之「整合性經貿實務專業知識」。就「應用法律」面言,這套整合性經貿實務知識,包括從事國際經貿活動所需要瞭解的國際經貿相關公法、私法、及慣例;就「法律應用」面言,學生亦須學習與貿易有關的財務會計知識、國際企業經營環境與策略等,俾其有能力見樹又見林,發揮實務應用之效果。
2.全英語交涉能力
本學程強調培養跨國經貿事務交涉能力,與前述以法律為中心的經貿實務專業知識相輔相成。為此,本學程特別了安排一系列特色課程,包括英文商務文寫作、英語口語論證、說服及溝通原理、英文商務契約撰擬及管理、談判原理及演練等課程,透過理論與實務兼備的途徑,有系統的提升經貿事務交涉能力。同時,大量英語授課科目,更有助於提升以英語處理經貿實務問題之能力。
3.經貿交涉通才加上特色專長
除了一般性培育目標外,本學程亦衡酌本校特色及學生屬性,力求專精與差異化而設定特色培育目標。其一是培養經貿/商務各領域(含投資、財稅、會計…等)具國際爭議預防及處理能力之人才。其二是培養公私部門具備貿易救濟素養之人才。
